INTRODUCTION – HOW THIS NOTICE APPLIES TO YOU
This Consumer Health Data Privacy Notice (“Privacy Notice” or “Notice”) supplements our Privacy Policy. It applies to Consumer Health Data that Rael, Inc. and its subsidiaries and affiliates (“Rael,” or “we,” or “us,” or “our”) collect from residents of Washington, Nevada, and Connecticut.
“Consumer Health Data” as used in this Privacy Notice means any personal information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status as defined in the relevant state consumer health privacy laws.
This Privacy Notice does not apply to personal information we may collect about you that is exempt from the relevant state consumer health privacy laws, which includes, without limitation, information collected about individuals when acting in their capacity as employees, independent contractors, job applicants, or health care providers, publicly available information, deidentified data, or protected health information that is subject to the Health Insurance Portability and Accountability Act (“HIPAA”).
CONSUMER HEALTH DATA WE COLLECT ABOUT YOU
We collect the following categories of Consumer Health Data with your consent, or to the extent necessary to provide a product or service that you requested:

For example, your use of our products (such as those for menstruation, incontinence, and skincare) may give us insight into your health status. We also collect Consumer Health Data when you interact with our website through our optional Cycle Care quiz that asks questions regarding your menstrual cycle and hormonal patterns and symptoms, which may give us additional insight into your health status.
SOURCES OF CONSUMER HEALTH DATA
We collect Consumer Health Data either directly from you when you purchase products on our website or complete our optional Cycle Care quiz, and automatically when you browse on our website or interact with us online.
PURPOSES FOR COLLECTION OF CONSUMER HEALTH DATA
We collect and use Consumer Health Data either your consent or as reasonably necessary to provide you with the products and/or service you have requested. For example, providing requested products and services to you may include shipping and delivering your requested products and making suggestions about what products are appropriate to you based on your responses to our optional Cycle Care quiz.
CONSUMER HEALTH DATA WE MAY SHARE WITH THIRD PARTIES
We may share Consumer Health Data with our affiliates or certain processors acting on our behalf and pursuant to contractual agreements who assist us in our everyday operations.
We also share Consumer Health Data as required or permitted by law to comply with a subpoena or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property or the rights, property or safety of others, including to law enforcement agencies, and judicial and regulatory authorities, to private attorneys who issue subpoenas or otherwise serve us with legal process and, to the extent required, the individuals or entities they represent, or in the context of a merger, acquisition or other corporate reorganization.
CONSUMER RIGHTS WITH RESPECT TO CONSUMER HEALTH DATA
In addition to certain privacy rights as described in our general Privacy Policy, depending on your state of residence, you may also have the following rights with respect to your Consumer Health Data:

Right to Know Third Parties: The right to obtain a list of all third parties with whom we have shared or sold Consumer Health Data to the extent permissible under the law and an active email or other online mechanism to contact them

We will respond to your request within forty-five (45) days of receipt of your request, or within ninety (90) days if it is reasonably necessary to extend our time to respond to your request, unless a different specified timeframe applies to certain requests.
We may require additional information to authenticate that you made the request(s). If we are unable to authenticate the request(s) using commercially reasonable efforts and asking for additional information, we will not be able to comply with the request(s).
If your request is denied, you may appeal that decision as specified in our letter of denial. We will process and respond to your appeal within the time permitted by law.
